This report summarises the performance of the NHS foundation trust sector for the final quarter of the year ending 31 March 2015. It found that foundation trusts treated 10.7 million emergency inpatients between April 2014 and March 2015, a 574,000 increase on the previous year. However, this increase in demand for care, combined with an over-reliance on expensive agency staff and the need to make cost savings, is putting trusts under sustained and exceptional pressure. The sector ended 2014/15 in deficit (-£349 million) for the first time, a sign of the increased pressures upon services.

This consultation seeks views on Monitor’s approach to making sure NHS foundation trusts are well run and can continue to provide good quality services for patients. After considering the feedback Monitor will update and publish a revised ‘Risk assessment framework’ in March 2015. The changes will take effect from 1 April 2015.

Peter Roderick and Allyson M Pollock argue that the licence conditions imposed by Monitor on NHS foundation trusts will lead to a reduction in hospital services, and they question the legality of Monitor’s approach Market forces and budget cuts are challenging the financial viability of hospitals in England, with NHS beds and other services continuing to close as thousands of staff are laid off. However, a further challenge to a comprehensive health service has received less publicity—an expected reduction by April 2016 in the services that NHS foundation trusts are legally obliged to provide. The reduction is a consequence of provisions in the Health and Social Care Act 2012 that have led to a change in the conditions imposed on foundation trusts.
